Terms of Service
Summary
These Terms govern use of Breyta services, including the Breyta web application, APIs, command-line tooling, and related workflow automation features (the "Service"). By using the Service, you agree to these Terms.
- You are responsible for your account, users, and use of the Service.
- You keep ownership of your content; Breyta gets a limited license to operate the Service.
- Breyta does not train its own models on your Customer Content. For BYOK model providers, processing by that provider is governed by your agreement with that provider.
- Unless law or contract requires otherwise, Customer Content is deleted from active systems within 90 days after termination.
- As of February 26, 2026, inline step-result payload limits are a 256 KB inline threshold and a 1 MB per-step result cap. Larger outputs can be stored as persisted blob artifacts by reference, subject to runtime and service constraints.
- These Terms are governed by Norwegian law, with mandatory consumer protections preserved.
1. Contracting Party and Scope
The Service is provided by Breyta AS (organization number 927 668 734), Løkenlia 9, 1352 Kolsås, Norway ("Breyta", "we", "us"). You can contact us at hello@breyta.ai.
These Terms apply to any individual or legal entity using the Service ("Customer" or "you"). If you accept on behalf of an organization, you represent that you have authority to bind that organization.
Within a workspace, users who create, install, or edit workflows act on behalf of the same Customer entity. Breyta does not treat such users as independent creators or separate contracting parties.
2. Accounts and Access
You must provide accurate account information and keep it current. You are responsible for safeguarding credentials and for all activity under your account.
You must promptly notify Breyta if you suspect unauthorized access, credential compromise, or other account security incidents.
3. Service Use and Acceptable Use
You may use the Service only in compliance with applicable law and these Terms. You are responsible for your workflows, triggers, integrations, and outputs.
Customer is responsible for internal workspace governance, including role assignment, permissions, approval flows, and policies for who may create, install, or run workflows.
You must not: (a) use the Service for unlawful, fraudulent, abusive, or infringing activity; (b) interfere with Service integrity, security, or availability; (c) attempt unauthorized access to systems or data; (d) bypass product safeguards or billing controls; or (e) use the Service to build a competing product by reverse engineering prohibited components.
Breyta may investigate suspected violations and take action including suspension or termination.
4. Customer Content and License
As between Breyta and Customer, Customer retains ownership of content, data, prompts, files, configuration, and outputs submitted to or generated by the Service ("Customer Content").
You grant Breyta a limited, non-exclusive license to host, process, transmit, and use Customer Content solely to provide, secure, support, and improve the operational reliability of the Service in accordance with these Terms and applicable law.
To maintain service reliability, Breyta enforces technical payload limits. As of February 26, 2026, inline step-result payload limits are a 256 KB inline threshold and a 1 MB per-step result cap. These limits apply to inline step results; persisted blob artifacts may exceed inline limits and are stored by reference, subject to runtime and service constraints.
5. BYOK and AI Processing
Breyta supports workflow steps and integrations that can involve third-party AI/LLM providers chosen or configured by Customer (including BYOK models and credentials).
Breyta does not train its own models on Customer Content. When Customer chooses a third-party model provider, provider-side processing is governed by Customer's agreement with that provider, including provider retention and model training terms.
Customer is responsible for selecting providers and settings appropriate to its compliance requirements. This includes providers, API keys, prompts, and workflow steps configured by Customer's authorized workspace users.
6. Privacy and Data Processing
Our processing of personal data is described in our Privacy Policy. Where Breyta processes personal data on behalf of a business customer as processor, processing is governed by our Data Processing Agreement (DPA), available at /data-processing-agreement.
Customer remains responsible for ensuring it has appropriate legal basis and notices for personal data it submits to the Service.
7. Security
Breyta implements technical and organizational measures designed to protect the Service. No system is perfectly secure, and Customer acknowledges that security controls reduce but do not eliminate risk.
Customer is responsible for secure usage practices, including account hygiene, connector configuration, and key/secret management for external services.
8. Fees, Billing, and Taxes
Fees are charged according to the applicable pricing page, order form, or enterprise agreement. Customer must pay all applicable fees and taxes, unless exempt by law.
If payment is overdue, Breyta may suspend the affected account after reasonable notice, unless prohibited by law or contract.
9. Suspension, Termination, and Deletion
Customer may stop using the Service at any time. Breyta may suspend or terminate access for material breach, security risk, legal requirement, non-payment, or abuse.
Unless a shorter period is required by law, or a longer period is required for legal hold, backup cycles, or contractual commitments, Breyta deletes Customer Content from active systems within 90 days after termination.
10. Intellectual Property
Breyta and its licensors retain all rights, title, and interest in and to the Service, including software, interfaces, and documentation, except for rights expressly granted to Customer.
No rights are granted to use Breyta trademarks, logos, or branding except as explicitly permitted.
11. Warranties Disclaimer
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from or related to the Service.
Breyta's aggregate liability for all claims under these Terms will not exceed the total amount paid by Customer to Breyta for the Service during the 12 months preceding the event giving rise to liability.
These limits do not apply to liability that cannot be excluded by law, including gross negligence, willful misconduct, fraud, or breach of confidentiality obligations where non-excludable.
13. Indemnification
Customer will defend and indemnify Breyta against third-party claims arising from Customer's unlawful use of the Service, Customer Content, or breach of these Terms.
Breyta will defend Customer against third-party claims that the Service itself infringes intellectual property rights, subject to prompt notice, Breyta control of defense/settlement, and Customer cooperation.
14. Changes to Terms and Service
Breyta may update these Terms from time to time. Material changes will be communicated through appropriate channels and become effective on the stated effective date.
Breyta may modify, enhance, or discontinue Service features. We will make reasonable efforts to provide advance notice for material adverse changes when feasible.
15. Governing Law and Disputes
These Terms are governed by the laws of Norway, without regard to conflict-of-laws rules.
Disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the Norwegian courts, unless mandatory law grants consumers rights to bring claims before local courts.
Nothing in these Terms limits non-waivable rights under applicable consumer protection law.
